CLIENT CARE PROGRAM

Estate Planning Is Not a One-Time Event
Estate planning does not end when documents are signed. In many ways, that is when the real work begins.
We were engaged a few years ago by a family following the death of its patriarch. Years earlier, he had retained one of the most respected law firms in the country to design a sophisticated estate plan intended to protect his assets during life and transfer them efficiently at death. The structure was carefully drafted. The tax strategy was sound. On paper, the plan worked.

Over time, however, the plan was never revisited. Trusts were not properly funded. Certain distributions were made inconsistently with the governing documents. Required gift tax returns were not filed. As years passed, changes in asset values, family dynamics, and administration practices quietly eroded the integrity of the plan.

When the patriarch passed away, the consequences were severe. The family faced an estate tax liability exceeding $50 million - a result that could have been avoided with disciplined oversight and ongoing review.

Unfortunately, this is not an isolated story. Even well-designed estate plans can fail if they are not properly administered and periodically updated. Assets change. Laws evolve. Families grow and shift. Trustees and fiduciaries change. Without regular attention, a plan can gradually drift out of alignment with the objectives it was meant to accomplish.
The risk is not in the drafting alone - it is in neglect.

The Client Care Program

Our Client Care Program was created to address this reality. It is a structured estate planning maintenance framework designed to help preserve the effectiveness of each client’s plan over time.

Through the program, we provide periodic communications regarding significant legal developments and offer scheduled opportunities to review estate planning documents in light of evolving personal, financial, and family circumstances. Where appropriate and agreed in writing, we may also coordinate with trustees, investment advisors, and accountants to support proper trust administration and alignment with governing instruments and applicable law.

Participation in the Client Care Program is optional and governed by a separate written agreement that clearly defines the scope of services provided. While we assist clients in reviewing and supporting the administration of their plans, clients remain responsible for informing us of material changes in their circumstances.

Estate planning requires more than careful drafting. It requires continuity, accountability, and periodic recalibration. The Client Care Program reflects our belief that protecting families and preserving intent is an ongoing responsibility - not a one-time engagement.
